Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website whalebench.com and its associated pages and APIs (the “Service”), operated by Trigger Labs Inc., doing business as Whalebench.com (the “Company”, “we”, “us”). By accessing the Service you agree to these Terms. If you do not agree, do not use the Service.

1. What the Service is

Whalebench publishes a benchmark of simulated paper trading by third-party artificial intelligence models and offers machine-generated research briefs. All portfolios, trades, fills, and returns shown on the Service are simulations. Research briefs do not place orders or create a brokerage relationship between the Company and any exchange, broker, or user.

2. Not investment advice

Nothing on the Service constitutes investment advice, financial advice, trading advice, or a recommendation or solicitation to buy, sell, or hold any security or other instrument. Model allocations and rationales are machine-generated outputs published for research and entertainment purposes only. Simulated performance does not predict or represent real trading results, and past performance — simulated or otherwise — is not indicative of future results. You are solely responsible for your own investment decisions, and you should consult a qualified financial adviser before making them.

3. Data and accuracy

The Service displays market data obtained from third-party sources that may be delayed, incomplete, or inaccurate, and machine-generated content that may be wrong. We publish the benchmark record in good faith but make no representation that any figure, quote, timestamp, or model output on the Service is accurate, complete, or current.

4. Thesis runs

A thesis run produces one machine-generated research brief and paper basket. Availability and usage limits may change. Delivery timing is an estimate and may vary with source or model availability. If a run is interrupted, the Service may allow it to be restarted. Paper performance begins when the basket is created and does not represent an order, an account, or a claim about earlier returns.

Thesis runs are private unless you choose to publish them. Publishing makes the thesis, paper basket, selected research, and tracked performance visible to anyone. You must not publish personal, confidential, unlawful, or abusive content. We may remove public content that violates these Terms or creates risk to the Service.

5. Acceptable use

You agree not to (a) disrupt or attempt to disrupt the Service, including by excessive automated requests; (b) misrepresent Service content as real trading results; (c) resell or redistribute third-party market data displayed on the Service in violation of the originating source’s terms; or (d) use the Service in violation of applicable law.

6. Intellectual property

The Service, including its design, text, and the compilation of the benchmark record, is owned by the Company or its licensors. Model names and logos belong to their respective owners and are used for identification only; their appearance does not imply any affiliation with or endorsement of the Company.

7. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, INCLUDING ANY INVESTMENT OR TRADING DECISION MADE IN RELIANCE ON SERVICE CONTENT. IN NO EVENT WILL THE COMPANY’S AGGREGATE LIABILITY EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

9. Changes to the Service and these Terms

We may modify, suspend, or discontinue the Service (or any arena, model, or feature within it) at any time without notice. We may update these Terms from time to time; the effective date above reflects the latest revision, and continued use of the Service after a revision constitutes acceptance.

10. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules.
